Bolsonarist deputy arrested after apologizing to military dictatorship

by João Marcelo

SAO PAULO – Federal Deputy, Daniel Silveira, of the Social Liberal Party (PSL), was arrested in flagrante delicto by the commander of the supreme minister Alexandre de Moraes, of the last 16, at his home, after publishing a video on his networks where he does offenses and threats to the ministers of the Supreme Federal Court, asks for the closure of the court and invokes the AI-5’s effective times.

AI-5, Institutional Act 5, was part of a series of 17 decrees made by the military government during the civil-military dictatorship that took place in Brazil between the years 1964 and 1985. This act was the harshest instrument of repression of the government, legitimizing the impeachment of individual and collective rights, giving scope for violence, torture and arbitrary arrests by the government. Because of these acts, the 1957 constitution was suppressed and the government started to legislate with these decrees, without the possibility of legal review.

The Bolsonarista deputy received the support of his followers and the followers of President Jair Bolsonaro, who claimed that the arrest is illegal for violating the right to freedom of expression, provided for in the Federal Constitution. However, Public Prosecutor Roberto Livianu said in an interview with Dire news agency that freedom of expression has a limit and the deputy has crossed that line. “The case of Deputy Silveira is not a simple case of offending or cursing individuals”. When a deputy offends a group or individuals, the issue is resolved by the Chamber of Deputies itself. “In his conduct there were offenses against ministers, but that was only a small part. What motivated the deputy’s arrest was the clear and unequivocal invocation of the return of AI-5. AI-5 was the most dreadful and darkest period that we we have lived in brazil for the past few decades and invoke this decree and invoke the time of hatred, torture and death “. Completed the prosecutor.
