Decision against Operation Lava Jato judge strengthens Lula’s speech

SAO PAULO – After 2 years, the Supreme Federal Court concluded the vote on the partiality of Judge Sergio Moro in the sentencing of former President Luiz Inácio Lula da Silva, declaring that the magistrate was biased in the conduct of the process.

In a public note, the defense of the ex-president considered the decision as historical for the Brazilian justice and that it corroborates with the idea of political and personal persecution already presented by the lawyers: “The damage caused to Lula is irreparable, involved an illegal imprisonment of 580 days and had relevant repercussions even in the country’s democratic process. The decision handed down today strengthens the Justice System and the importance of due process”, said the lawyers.

The decision taken on Tuesday (23) took into account the fact that Moro accepted the invitation of President Jair Bolsonaro to take over the Ministry of Justice from January 2019, illegal interception disclosures and other measures that deny the right to an impartial judgment.

In the section, Minister Gilmar Mendes stated: “The legacy left by this case is the affirmation of the duty of the Brazilian Judiciary. Violence may even be able to exist, it may even reign supreme in the light of the shadows, but never – absolutely never – will it live or resist the force of Justice“.

Sergio Moro manifested himself this Wednesday afternoon (24) in a public note, saying that he feels “absolute tranquility” in relation to the correctness of his decisions and that “all the accused were treated in the processes and judgments with due respect, with impartiality , and without any animosity on my part, as judge of the case ”.
