SAO PAOLO – The labor court ruled last week, through a preliminary injunction, that Ford do Brasil should suspend mass layoffs at the Taubaté (SP) and Camaçari (BA) plants. The decision prohibits suspension of wages, leave, individual agreements and dismissals, until the agreement between the company and employees is terminated.
According to the Public Ministry, the company would be refusing to make collective agreements with workers, “limiting itself to calling the union to discuss the payment of values to workers”.
In the city of Taubaté, the judge of the second Federal Labor Court, Andréia de Oliveira, also prohibited the automaker from selling the unit’s machinery and other goods. In addition, the judge also demanded that the company submit a collective bargaining schedule within 30 days. “The collective bargaining schedule should consider the context of social isolation and the need for the necessary precautions not to contaminate workers by Covid-19 and / or the impossibility of agglomerations by workers,” says the judge in an interview with Folha de Sao Paulo.
In Bahia, the Public Ministry argues that Ford had committed to the union in 2020, that there would be no massive layoffs and that any changes would be discussed before with workers’ representatives, which did not happen.
The court also determined that the companies will have to present to the unions in the category information that is requested for the continuation of the negotiations and for the decisions that will be made by the category, if the companies do not comply, a fine of 10 thousand reais per day will be charged. “In order to receive the information, the union must formalize the request and the company must deliver the requested documentation within 15 days or justify the reasons for not delivering the said documents, all in writing and upon receipt,” says the decision.
